师生恋是否该被法律禁止?

【话题探讨】两会委员代表热议师生恋。昨天,南京审计学院官方发布的《师德建设长效机制实施办法》称,南审史上首份师德负面行为清单出台,9项行为被视为负面行为,其中第四条即为“师生恋”。办法中还称,学校是“在教育部反对‘对学生实施性骚扰或与学生发生不正当关系’的基础上,进一步明确提出反对‘师生恋’”。也有代表认为,如果师生之间两情相悦,不违背伦理道德,不是第三者插足或者相互利用,有什么不可以呢?禁止也许显得太过了。但大多数代表仍表示,师生恋,法律虽未禁止,但不提倡。

I think the problem lies in the question of whether a university has the authority to ban two adults from falling in love with each other. The vast majority of undergrads are over the age of consent—some by as many as five or six years. It is said that Huang Lei, a Chinese actor, fell in love with his Sun Li, also a movie star, at the first sight when Huang, who was a teaching assistant at the Beijing Film Academy met Sun, who was a candidate attending the preliminary test. After Sun enrolled, Huang started dating Sun and their relationship lasted nine years before they tied the knot.

Although the law has not banned romantic relations between university teachers and students, they should not be encouraged. In my university there is a rule that states that markers are not allowed to have a 'conflict of interest' so if a professor is involved with a student then the professor cannot judge the student's work as it would be seen as a conflict of interest. In the US, universities like Harvard, Yale and UC Berkeley have similar rules that forbid faculty members from having relations with their students.

3. Steven (China)

The most important reason why universities ban teachers from having physical relations with their student is the "unequal status." Teachers can trade better grades or some other unfair advantage in return for sexual favors. Some of them can even threaten the students that if they don't agree to their demands they would get lower scores. When something like this happens then it is no longer a matter just between two people because this violates university rules and harms students' academic performance.

4. Richard (US)

Harvard University also has similar ban. The prohibition flies in the face of personal liberty endowed by the American constitution. We may fall in love with someone somewhere, including the teachers in our colleges, and to ban teacher-student relations constrains human nature. Besides, the love affair between Hannah Arendt and Heidegger as well as Susan Sontag and Philip Rieff, to some extent, helped these women become more successful in their future career.

5. Christina (China)

The aim behind the ban is to prevent teachers from abusing their powers, and stopping students from seducing their teachers to get some preferential treatment in grading or the entrance exams. To keep the teacher-student relations pure, university authorities should enhance teachers' morality and make the enrollment process more transparent.
